ZONING ORDINANCE

ARTICLE SEVEN
300.110           INDUSTRIAL DISTRICT, I
 
The following provisions shall apply to all Industrial Districts, I:

300.111           Purpose.
Sec. 7.01. The primary purpose of Industrial Districts, I, is to provide areas for the encouragement and conduct of industry; for processing selected raw and semi-finished materials; for storage of industrial products; for location of whole­sale establishments.

300.112           Property uses.
Sec. 7.02. No land or premises shall hereafter be used, and no building or structure erected, used or altered for other than any of the following purposes:
7.02APrimary uses (without special approval).
1.      The manufacture and testing of any product, goods or materials, (not including those items listed under Section 7.02B), including repair, storage and sale at wholesale of such products or materials.
2.      Wholesale commercial establishments.
3.      Reduction, conversion and disposal of waste goods and materials.
4.      Public utility buildings and structures including storage.
5.      Lumber and coal yards, and storage of similar raw materials.
6.      Accessory uses customarily incidental to any permitted or approved use including office facilities, food services for employees, and caretakers' buildings.
7.      Public parks.
7.02B Uses by special land use permit as provided by section 8.05 [300.135].
Subject to the requirements of Section 7.07 [300.117], land or premises may be used for any of the following purposes:
1.      Abattoir.
2.      Acid manufacture.
3.      Cement, line [lime], gypsum or plaster of paris manufacture.
4.      Crematory.
5.      Distillation of bones.
6.      Explosive manufacture or storage.
7.      Fat rendering.
8.      Fertilizer manufacture.

 

 
9.      Garbage, offal or dead animals, reduction of dumping.
10. Gas (illuminating or heating) manufacture.
11. Glue manufacture.
12. Petroleum refining, including fermentation (distillations of operations for manufacture of denatured alcohol), provided Section 7.07 A-D [300.117] shall be complied with.
13. Smelting of copper, zinc or iron ores.
14. Stock yards.
15. Junkyards, including baling and disposal of scrap materials but not as dumps.
16. Any use not otherwise permitted by right or by special use in this ordinance, may be considered as a special land use in this district.
17. Broadcast towers.
7.02C Accessory uses. Accessory buildings, structures and uses customarily incidental to any Primary Use or Approved Use.

300.113           Minimum land area.
Sec. 7.03. Every building hereafter erected shall be located on a parcel of land not less than ten thousand (10,000) square feet in area with not less than one hundred (100) continuous feet frontage on a public highway.

300.114           Minimum yard requirements.
Sec. 7.04.
1.       Minimum yard requirements shall be as follows: front yards fifty (50) feet; side yards twenty-five (25) feet; rear yards fifty (50) feet.
2.          No building shall be erected within five hundred (500) feet of any portion of a school house, church, cemetery or hospital.

300.115           Minimum floor area.
Sec. 7.05. There are no minimum floor area requirements in any Industrial District.

300.116           Height of buildings.
Sec. 7.06. No building shall hereafter be erected or altered exceeding a height of four (4) stories of sixty (60) feet, whichever is lesser except upon approval of the Township Planning Commission and its determination that the buildings do not exceed the fire-fighting capabilities of the Township.

300.117           Supplemental requirements.
Sec. 7.07.
7.07A Drawings. In addition to the requirements of Section 9.03 [300.173], the drawing shall include the location of all parking lots and loading facilities; all waste disposal areas; all roads and drives on the premises; all fences, enclosure walls and barriers; all special construction on the premises.
7.07B Statement of operating conditions. The application shall include a written statement of the effects of the operation on traffic on water and air pollution; on noise and glare conditions; on fire and safety hazards; on emission of dangerous or obnoxious matter; and on the proposed treatment of any such conditions to maintain the same within the limitations of the Ordinance. It shall show the plans for the disposal of sewage and all industrial wastes. It shall specify the fuels to be used, including plans for smoke and pollution control.
7.07C Determination by planning commission.
Following receipt of such application, the Zoning Administrator shall file his recommendation with the Planning Commission which shall make the determi­nation thereof. The Planning Commission may hold a public hearing upon the application.
7.07D Standards of performance.
1.         No use shall constitute a nuisance to adjacent premises or defeat the purpose of this Ordinance as expressed by Section 1.02 [300.012].
2.          No use shall discharge any produced dust, odorous matter or noxious, corrosive or toxic fumes; or physical vibrations; or heat or glare beyond the premises whereon located.

 

3.          On-premises parking and loading space shall be provided for all owned and leased vehicles. Parking space no less in proportion than one space for every three (3) employees shall be provided on the premises. The total number of intended employees shall be specified.
